Regulation (EU) 2023/1114, Article 3(1)
October 16, 2026
Under MiCA, a crypto-asset service provider's home member state is the country where it has its registered office. That country's competent authority grants its authorisation and supervises it. A host member state is any other member state where the CASP provides crypto-asset services through passporting.
For a counterparty check, the home member state tells you which regulator's register to consult. A CASP serving customers in Poland holds its permission from a regulator in another member state, because Poland had authorised no CASPs by 13 October 2026.
